By downloading, installing, or using any application ("App") published by HYXDA ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of our Apps, nor may you reverse-engineer or attempt to extract the source code.
Some Apps may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree not to use our Apps for any unlawful purpose; to violate any applicable laws, regulations, or third-party rights; to transmit malware, viruses, or any destructive code; to interfere with or disrupt the operation of our Apps or servers; to attempt to gain unauthorized access to any part of our Apps; or to use our Apps in any manner that could damage, disable, or impair our services.
All content, features, and functionality of our Apps — including but not limited to text, graphics, logos, icons, software, and underlying code — are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade names.
Our Apps may contain links to or integrate with third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of such services is at your own risk and subject to their respective terms.
Certain features of our Apps may be offered on a subscription basis. Payment is processed through the applicable app store (Apple App Store or Google Play). All purchases are subject to the app store's payment terms. Refund requests should be directed to the respective app store.
Our Apps are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Apps will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Apps, including but not limited to loss of data, revenue, or goodwill, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless HYXDA, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Apps or violation of these Terms.
We may suspend or terminate your access to our Apps at any time, with or without cause, and with or without notice. Upon termination, all rights granted to you under these Terms will cease immediately.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HYXDA is incorporated, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. Updated Terms will be posted within our Apps or on our website. Your continued use of our Apps following any changes constitutes acceptance of the revised Terms.
